Has the Northern California Federal Bench become anti-patent, or is it just conventional wisdom from years ago? In the latest ruling that everyone has been buzzing about, Judge William Orrick III decided that two camera tech patents GoPro was accused of infringing cannot be protected by patent law. Whether or not you could win a patent case used to depend on what circuit you filed in, but now, Professor Risch is not so sure if this is the case. Jack Russo asks Professor Michael Risch if it makes any sense to have a great amount of variation between the districts when the overall goal is to have uniformity in patent litigation.
