The Constitution’s “ideal” for the US Supreme Court is a group of learned individuals debating in a bipartisan manner with the purpose of resolving questions of Constitutional interpretation to uphold the rule of law in the United States. Today, the US is far more divided and so is the High Court: Are the learned justices now talking past each other instead of grappling with the issues at the heart of the Constitutional debate? The rejection of President Biden’s student loan forgiveness program provides a recent example.
